Marijuana Ban Ruled Unconstitutional in Argentina

To Americans, who can't seem to agree on medical marijuana use, which has been shown to improve quality of life for sufferers of many diseases, this should come as a shock. Argentina's supreme court has ruled not just that marijuana use should be legal, but that any prohibition on personal use is unconstitutional.

The court added, however, use must not harm others and did not advocate a complete decriminalization of marijuana. What it did say was:

"Each adult is free to make lifestyle decisions without the intervention of the state. Behavior in private is legal, as long as it doesn't constitute clear danger. The state cannot establish morality."

Naturally, the ruling restricts use to adults, and the use must be done in a private setting (no second-hand smoke!) without affecting third parties.

This ruling overturns convictions on eight adults who had been prosecuted for possession of marijuana.
